Overview
These Terms of Service govern the use of GamerCloset and any submission, shipment, sale, payout, donation, or related interaction with the platform. By creating an account, submitting items, accepting an offer, requesting a shipping label, or sending items to GamerCloset, the user agrees to these terms.
Eligibility
- Users must be at least 18 years old, or use the platform through a parent or legal guardian with authority to bind the account.
- Users must provide accurate account information.
- Users must have legal authority to sell, donate, or otherwise transfer the submitted items.
GamerCloset may suspend, restrict, or terminate any account that provides false information, attempts to abuse the offer system, or violates these terms.
Account Responsibility
- Users are responsible for maintaining the confidentiality of account credentials.
- Users are responsible for ensuring submitted contact, payout, and shipping details are accurate.
- Users are responsible for reviewing all offers, revised offers, and status updates associated with their account.
GamerCloset is not responsible for losses arising from inaccurate account details supplied by the user.
Submission Accuracy
Users agree that all submissions must accurately reflect:
- the items included
- the condition of the items
- the presence or absence of cases, manuals, inserts, controllers, cords, accessories, and similar components
- the quantity of items being submitted
Submitting photos does not guarantee that all visible or claimed items will be included in the final offer. Offers are generated from the items recognized, added, and accepted within the submission workflow.
Preliminary Offer
Offers displayed before shipment are preliminary and are based on:
- submitted images
- item recognition
- user-entered corrections or manual additions
- declared completeness and condition
- GamerCloset's internal pricing and valuation rules
Preliminary offers are not final until received items are inspected.
Offer Acceptance
When the user accepts an offer:
- the accepted payout amount becomes the current agreed payout
- the user proceeds to shipping and payout setup
- the user may not continue editing the offer contents except as allowed by GamerCloset's workflow
- the accepted offer may still be subject to inspection-based adjustment if the received shipment materially differs from what was accepted
Inspection and Verification
After receipt, GamerCloset may inspect all shipped items to verify:
- item identity
- quantity
- completeness
- condition
- whether the contents materially match the accepted submission
GamerCloset may determine that a shipment differs from the accepted submission if, for example:
- items are missing
- extra items are included
- items are damaged beyond the represented condition
- a different version or product was sent
- hardware is non-functional when functionality was expected
- materials necessary for valuation or resale are missing
Revised Offer Policy
If inspection reveals a material difference that reduces the value of the shipment, GamerCloset may issue a revised offer.
A revised offer requiring a lower payout must be approved by the seller before payment is issued.
If inspection reveals information that would increase the payout, GamerCloset may, at its discretion, either:
- honor the originally accepted payout amount
- issue an increased payout
GamerCloset is not obligated to increase payout amounts after acceptance unless required by law or separately stated.
Seller Rejection of Revised Offer
If the seller rejects a revised offer:
- GamerCloset may hold the shipment pending further instructions for a limited time
- if the seller requests return of the items, the seller is responsible for all return shipping costs and any applicable handling fees if disclosed
- if return shipping is not paid within the stated response period, GamerCloset may treat the shipment as abandoned property to the extent permitted by law
Shipping and Label Use
If GamerCloset provides a prepaid shipping label:
- the label may be used only for the associated submission
- the seller must package items securely and in accordance with any provided instructions
- the seller is responsible for ensuring all intended items are actually included in the shipment
- GamerCloset may use the carrier tracking number as the official shipment identifier for operational and support purposes
Loss, Damage, and Packaging Responsibility
Until GamerCloset receives and records the shipment, the seller remains responsible for:
- secure packaging
- including the correct items
- using the correct shipping label
- delivering the package to the designated carrier
GamerCloset is not responsible for shipment issues caused by improper packaging, incorrect labeling, or seller error before receipt.
Payment
Payment is issued only after:
- the offer is accepted
- required payout details are completed
- the shipment is received and processed
- any revised-offer issue is resolved if applicable
Payment timing may vary depending on:
- shipment delivery timing
- inspection timing
- payout processor timing
- fraud, abuse, or verification review
Payment Methods
Available payment methods may include:
- PayPal
- Venmo
- check
- donation
- others as made available
The seller is responsible for entering valid payout information. GamerCloset is not responsible for delays caused by incomplete or incorrect payout details entered by the seller.
Donation Option
If the seller chooses donation:
- no payout will be issued
- the submitted items become the property of GamerCloset upon acceptance and processing
- donation selections may be treated as final once shipment is received and processed
Cancellations
A seller may be allowed to cancel after accepting an offer only before the shipment enters active carrier transit, as determined by GamerCloset's workflow and carrier status.
Once a package has been scanned into transit or received for processing, cancellation may be denied or treated as a return request subject to shipping charges and policy rules.
Fraud, Abuse, and Misuse
GamerCloset may limit, suspend, refuse, or terminate submissions or accounts for behavior including:
- repeated manipulation attempts
- repeated misleading submissions
- abuse of submission limits
- shipping incorrect or materially misrepresented contents
- fraud or suspected fraud
- use of multiple accounts to evade restrictions
- attempts to exploit pricing, image recognition, or workflow systems
Intellectual Property and Platform Rights
All content, design, pricing logic, software, and workflow systems on GamerCloset are owned by GamerCloset or its licensors. Users may not reverse engineer, scrape, duplicate, or misuse the platform except as allowed by law.
Limitation of Liability
To the maximum extent permitted by law, GamerCloset is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the platform, including but not limited to lost profits, shipment delays, data loss, or dissatisfaction with offers.
Changes to Terms
GamerCloset may update these terms from time to time. Continued use of the platform after an update constitutes acceptance of the revised terms where permitted by law.
